Paying on time keeps Marketplace coverage active. HealthCare.gov and CMS highlight three ideas Texas enrollees should know: the binder payment, the grace period, and termination for non-payment.

The binder payment (your first premium)

After you pick a plan, enrollment is not finished until you pay your first premium—often called a binder payment—directly to the insurance company, not the Marketplace.

According to HealthCare.gov, coverage will not start until you pay that first premium (if you have one). Follow your insurer’s instructions; many companies let you begin payment from your Marketplace account.

CMS Federally-facilitated Marketplace guidance says that for regular coverage effective dates, the binder deadline must be no earlier than the coverage effective date and no later than 30 calendar days afterward. Missing the binder can mean the plan never takes effect—different from a mid-year termination after coverage already started.

After you pay, confirm enrollment under “My Plans & Programs” in your Marketplace account and watch for your membership card.

If you miss a later monthly premium

Rules differ based on whether you receive advance payments of the premium tax credit (APTC).

If you use APTC (and already paid at least one full month)

HealthCare.gov and 45 C.F.R. § 156.270 provide a 3-month grace period when you have a Marketplace plan, use APTC, and already paid at least one full month’s premium in the benefit year.

HealthCare.gov says your grace period may differ under state rules. Ask your insurer and the Texas Department of Insurance. Do not assume you have three months without APTC.

If coverage ends for non-payment

According to HealthCare.gov:

Outstanding balances may still be collectible, but Marketplace rules restrict issuers from blocking a new enrollment solely because of past-due premiums on a prior policy.

Stay covered

  1. Pay the binder on time so coverage starts.
  2. Use reminders or autopay with the insurer.
